Guidelines for addressing problems with six sigma were established and it was also suggested that projects in which six sigma is applied should always give positive outcomes. This seek Guerrilla marketing and advertising outlines and analyzes the effect of the GM and its perception by the customers and the problems and opportunities that advertisers have with GM strategies. Guerilla marketing It is non- naturalized as it does not confine itself to the veritable(a) media or channels of advertising and it uses content strategies that may be more creative or even bizarre. Guerrilla marketing, as it name indicates, largely draws parallels from the Guerrilla warfare strategies. In the case of Guerrilla warfare, the means of war are not straightforward and people do not fight by rules of conventional warfare. The element of surprise is used heavily to conduct short but highly forceful attacks on the opponents. In the same way, Guerrilla marketing follows the plan of surprise and taking the customer unguarded, and projecting the advertised content or message in a targeted manner when the customer least expects it or is least prepared to steal himself or herself against the impact (Tufel, 2004). The logic behind using the surprise element is that most customers being exposed to innumerous advertising messages passim thei r day through TV, the Internet, billboards, newspapers, pamphlets, in shop point of purchase displays etc. are mostly able to immune themselves against these messages (Susca et al, 2008). There is too much jumbal of advertising messages and customers can tune themselves out of the picture when plagued by a huge amount of information that impinges on their senses.

Week 3 Assignment - Essay ExampleThe issue slightly miscarriage is highly contemptuous both from the legal, philosophical and more particularly theological perspective. While current law tends to be more liberal with the legalization of abortion in some states and some countries, the controversy and debate about its propriety is still as heated as before. The crease whether it is right or wrong has not yet settled and confounded by the evenly heated discourse about the womans right to choose with what to do with her own body and the fetus/zygote right to live. The arguments about abortion are grounded on several philosophical and theological premises. First is the argument about when did life begin? Some posits that life begins at conception epoch others argue that life already begun at implantation. The Catholic Church brings forth the argument of its foremost theologian, St. Thomas Aquinas who believed that life actually begins at 40 days for male and 80 for female. He based th is theological basis of his from the Greeks view about fetal development. It became more acceptable til now that life begun when the fetus acquired personhood and/or ensoulment which has the same value and right as any human being to live. Having accepted this standard of where life actually begun, limits the argument to the point of when a fetus gains personhood. Development in science has helped to settle this dilemma for it provided that the fetus is already a viable human life at the end of second trimester of pregnancy. But even if personhood or ensoulment is already established, there are however circumstances that would make abortion morally acceptable. This particularly admittedly when the pregnancy and/or is threatening the mothers life that continuing the pregnancy would induce the death the mother. Thus, in this instance, abortion becomes

Persepolis - Essay ExampleHer description of a significant event from Iran history, the movie theater burning, and the expressive style it is done will help to understand her exploit to full extent. (Satrapi, 2002).The book of Satrapi is peculiar from the point of view of the way of the events description. They are depicted on the illustrations which are accompanied by short but crisply comments, like The Shah said that a group of religious fanatics perpetrated the massacre. (Satrapi, 2002, 15), which is, similarly, an attempt to simplify the description. Simplification develops more than just the accentuated written messages (Nolan, 2010, 3). The pictures about the Rex Cinema fire see to it the images of a burning building of the theater and the metaphorical depiction of the victims of the fire who were burnt inside. Keira Nolan also states that a simplified art style works best, as it amplifies only the primary features of the text, unlike realism which would be far more focuse d on social details., which means that Satrapi focuses primarily on terrible consequences of the tragedy. (Nolan, 2010, 1). This way the author instigates the readers thinking on both the reason and the party which caused this terrible fire. Satrapi also pays attention that the firemen arrived too late, forty minutes later(prenominal) and this is also a point of significant concern. (Satrapi, 2002, 15).The mentioned event is also described from historical perspective. The historians, the date and the death toll aside, also pay attention to the versions of the fiendishly fire, which are, obviously, opposite and are similarly to have been elaborated to defend each of the blamed parties. Of the other two, choices, the purchase of the Epsilon 4311 has neutral consequences, while the other, the Epsilon 45 is bad for the economy. b. Rights-Based Rights-based ethics is could be closely linked to the philosophy of hypothesise by John Locke emphasizing the rights of the individual and most importantly property-rights. This means that a persons property should be protected against being compromised by another partys action. The individual is a person who as contracted with or bought into this belief and thus has the overall responsibility to protect the property rights of others. Government may or may not protect these rights. We know in Laccaria, like many developing nations, software and hardware licenses are a good deal ignored. Should Eagle be complicit with this illegal action and vio lation of property rights? The purchase of the Epsilon 45 is illegal and violation of licensing agreements. The other two options are both viable using this ethical logic. Given that the Informatics Bureau advised purchasing the Epsilon 4311 this would probably be the tipping point for a decision over these two options.

Mean Variance Analysis - Portfolio Theory and Diversification Assignment

Mean Variance Analysis - Portfolio Theory and Diversification - Assignment ExampleThe most common objective of diversification is not to do all eggs in the same basket. Diversification may have different forms. A well-diversified portfolio is the one in which all the constituents do not have any relationship among separately former(a) (Fabozzi et al, 2002). That relationship preserve be measured by using statistical technique of correlation coefficient. Correlation really measures how much a constituent is associated or linked with the other constituent such that in case if the correlation is equal to or near to 1 among two constituents, then those two constituents would be called as highly associated with each other as having strong relationship between them. On the other hand, if the correlation becomes to 0, it instrument that there is no relationship between the constituents and they are independent of each other. The third possibility is that the correlation is computed as -1 or near to it which means that the constituents has strong negative relationship among each other and they are associated with each other in opposite manner. So according to portfolio theory, the risk of a portfolio can be minimized in case if the portfolio is well-diversified in terms if its constituents such that the constituents either do no have any relationship with each other i.e. correlation = 0 or they have opposite relationship with each other such that correlation = -1 or near to it. ... In case if the constituents do not have any relationship with each other then the constituents would show a unique behavior irrespective of any other constituent. As a result, if the price of any constituent decreases, it ordain not have any impact on the prices of other constituents and in this way, the overall volatility of the portfolio will remain substantially lower. The negative relationship among the constituents of the portfolio will compensate each other such that if the price of one constituent decreases, than it would be effectively compensated by the other constituent such that its price would be increased, thus it would result in managing the overall risk of the portfolio given that the required return of the portfolio is ensured. This pattern of portfolio would be considered as well-diversified and ensure the same return but with the reduced level of risk. The single return that can be earned on each constituent would be similar to those which are kept in a well-diversified portfolio, but the overall risk of the portfolio would be substantially less than every individual constituent. Diversification Principles There are different kinds of diversification strategies which are available for the investors, some of them are discussed as under Diversification through Different addition Classes The most famous diversification strategy holds that the constituents of a portfolio must be well spread in different asset class such that investment can be ma naged in different proportions under stocks, bonds, marketable securities, commodities, property and real estates, currencies etc (Shefrin, 2000). These asset classes provide a large area for diversification and precisely any relationship can be found among these asset classes. Diversification through

Anemia - Research Paper ExampleThis condition affects the amount of oxygen that is delive red-faced to the embodys organs as hemoglobin is responsible for the aforementioned process and thus it is essential that unmarrieds hapless from this disease attain medical care as soon as possible to avoid the onset of hypoxia. Anemia is one of the most common blood disorders found in individuals (WHO 2008). in that location are trinity main ways that an individual can end suffering from anemia as a result. The second process through which the disease can manifest is via hemolysis (Kumar et. al 2007). This refers to the excessive destruction of the blood cells. Charles Darwin & theory of evolution Essay Example for Free

Charles Darwin theory of evolution EssayCharles Darwin in his theory of evolution suggests that man evolved from ape-like animate beings. In this theory, there is an indication that the early man was distinguishable from apes. Hence, some discovery have pointed out the early man could stand upright while apes could not. The turn over of the apes were made for climbing and clinging while the early mans hands were jointed in such a way that he could use and make tools. Despite the little evidence on the tool-making affair of early man, carcass of polished bones suggest that he made simple digging tools from bone. Generally, the early man appeared about 3 million years ago. However, the 1932 discovery by Louis Leaky in South Western Kenya reveal that Ramapitheticus is probably the oldest man known to date. Ramapitheticus is believed to have lived 12 to 14 years ago. Astralopitheticus, also known as the southern ape, were for the first time observe in South Africa. The creatur e had human-like maxillary form and walked upright. The teeth resembled that of human being and it has a full face, jaws and an endocranial bone. Some scientist believes that this creature was the first branch of apes that evolved into red-brick man. Other evidences of Australopithecines have been unearthed at Kromdraii, Makapansgat and Swartkrans. The homo habilis also known as the handy man are believed to be the first true humans. Discovered in 1915 by Mary Leaky, it lived 1. 8 millions ago in Africa. adult male habilis are credited with making stone tools and basic weapons. They were taller than their ancestors. Homo habilis had huge non-human molars, a small brain, and a large sagital crest. Their main diet was probably wild fruits, nuts, roots, and vegetables. Although, the handy man did not have skills to make exonerate they built fire camps out of existing fires. The Homo erectus succeeded the Homo sabilis. They existed between 1. 6 million BCE to 30 000 BCE.He was about the same size as the modern man although the size of their brain was two third the size of human brain. Their tool making skills improved considerably they made stone axes and knives. Homo erectus made fire and cooked their food. Besides fire camping, fire brought about social occasions in. Homo erectus had much semblance with human especially their teeth and jaws. They walked upright. Scientist discovered that these early men skeleton was shaped like modern man. Their skulls grew forward for their brain to develop. Besides, creating stone tools, and bone needles and fish hooks, the Homo sapiens sew frock from animal skins. The Homo sapiens were also hunters and gatherers. In conclusion, several other discoveries that purport the existence of early man lack credibility. Piltdown man, also known as the dawn man and scientifically referred as Eanthropus dawsoni was discovered by Charles Dawson in 1912. He concluded that Piltdown man existed in 500 000 million years ago, had ape-like mandible but the teeth and the skull resembled that of human being. However, after forty years of discovery, Kenneth Oakley, Joseph Weiner and Wilfred Le Gros Clark termed the discovery as a hoax. They claimed that the skull was indeed human and the jawbone was of a modern ape whose teeth were filed to resemble that of human. Again, Nebraska scientifically known as Hesperopithecus haroldcookii was discovered in Pliocene deposits of Nebraska in 1922 by Mr. Cook. It was publicized by heat content Osborn who likened its teeth to that of man. Unfortunately, he failed to conclude whether Hesperopithecus was an ape or human ancestor. References Muller, H. J. Lord Byron’s Don Juan Essay Example for Free

Lord Byrons strike Juan EssayLord Byrons father Juan is a satiric poem that offers a seemingly idiotic and serious outlook of sexual activityuality. In three different sexual relations in three different places, the events that surround Don Juan are both absurd and questionable. From an early affair with Donna Julia, to an innocently, beautiful engagement with Haidee and finally an unfulfilled and avoided relation with the Sultana Gulbeyaz, Don Juan escapes through the clutches of screw with shattered innocence, a furrowed heart and near fatal eroticism. As Byrons satiric genius developed, it prevailed to employ less and less of the traditional axe-swinging of the neoclassic satirists and to approach to a greater extent and more the mocking and ironic earthly concernner of the Italian burlesque poetsFinally, when his satiric genius had fully ripened, Byron found complete expression in serious and social sarcasm (Trueblood, 19). From an early age, Don Juan was destined to wander through a maze of sexuality. One can see this unfolding by merely looking at his parents marriage. Let us primary look at Don Juans parents, Don Jose and Donna Inez. Byron presents the couple ironically and comically. Donna Inez, moralitys straitlaced personification perfect past all parallel (Byron, I, 16-17), still is not good enough for Don Jose.A man with a greater interrelate for women than knowledge, Don Jose is not a particularly admirable father figure. He lacks respect for his wife, and like a lineal son of Eve, /Went plucking various fruits without her leave (Byron, I, 18). This allusion to Don Jose being a son of Eve is virtuallywhat accurate and satirical. Like Eve, he is careless and unaware of the consequences of his moveions. However, as Eves son, the offspring of divinity fudges beautiful creation, Don Jose is given holy qualities. He cannot be blamed for his actions, and for a long time, Donna Inez blinds herself from his wrongdoings and maintains th eir marital status. Their relationship is practically pointless a mother and father that wished each other dead, not divorced. The unification of Don Jose and Donna Inez is a comical union. What men call gallantry, and gods adultery, / Is much more common where the humors sultry (Byron, I, 63). The cardinal reach a point where they cannot stand each other, yet for some reason, they stay together. At the same time, marital disputes and unfaithfulness make for no laughing matter. They were, and continue to be, problems for couples all around the world. Byron depicts Don Jose and Donna Inez at each others throats, but still sleeping status by side. To further solidify ironic humour, when their divorce inevitably approaches, Don Jose falls ill and dies. His shoemakers last right before getting divorced symbolizes the death of marriage. Byron might be poking fun at the fact that more and more marriages end in divorce, and that the fire shared by soul copulate typically burns out. Des pite being an unfaithful and uncaring father, the narrator paradoxically calls Don Jose an honourable man. The death of the father creates increased duties for the mother. Donna Inez decides to enlighten Don Juan with the teachings of art and sciences, but in doing so, neglects teaching him the basic facts of brio. Someone uniformed about basic life necessities is at risk of not crafty how to act and react to certain situations. Though Don Juan does not attempt to manipulate those around him, his lack of direction leads him to being a dupe of a harsh, vindictive world.Ladies even of the most uneasy virtue / Prefer a spouse whose age is short of thirty (Byron, I, 61). This is a bold statement from the narrator, but it is for sure the case for Donna Julia, Donna Inezs friend. She falls for the young and handsome Don Juan when he turns sixteen, though her affection chicken feeded before indeed. Donna Julia is seven years older than Don Juan. Her revel for the young lad is both c omic and paedophilic. Donna Julia unsuccessfully resists temptation, and eventually takes Juans innocence and sends him along a path of sexual confusion. As the narrator states scour innocence itself has many a wile / And will not dare to trust itself with truth, / And love is taught hypocrisy from youth (Byron, I, 72). Her inability to resist Don Juan is satirical for he is sexually inexperienced. Being sexually unsatisfied, one would think Donna Julia would pursue a lover with sexual experience. Her longing for such a young man is bizarre and questionable. Byron seems to the think temptation integral to creation, and fall the inevitable consequence of temptation (Ridenour, 29).For Don Juan, an impending relationship with Donna Julia is most appealing, but in turn, it is the start of spiralling, sexual journey. Oh pleasure, youre indeed a pleasant thing, / Although one must be damned for you no doubt (Byron, I, 119). Unfortunate consequences of plentiful pleasure tend to follow Do n Juan around. His romance with Donna Julia is of short lived passion. One November night, Don Alfonsos suspicions reach a new height and he confronts Donna Julia in her suite. The season is epochal November represents the conclusion of fall and an approaching winter. The trees lose their leaves, plants and shrubs dwindle and the days get shorter and colder. These events can be compared to Don Juan and Donna Julias relationship, as its fire is extinguished by an upset Don Alfonso. Man is chained to cold earth and is able to alleviate his sufferings completely by his own efforts by love and glory and, as we learn in the second stanza, by poetry. This very poem is presented as an attempt to give color, form, warmth to a world naturally colorless, indefinite and vibration (Ridenour, 33).This thought can also be applied to Donna Julia, who was brightening her world with the young Don Juan. Though she promised Don Alfonso to never disgrace the ring she wore, she falls victim to the f act that pleasures a sin and sometimes sins a pleasure (Byron, I, 133). Donna Julia acts like a double-edged sword when confronted by Don Alfonso. She gets upsets by his unfaithful accusations, while the whole time, Don Juan is hidden beneath a pile of clothes. Satire was Byrons natural and habitual resolution to censure and injury (Trueblood, 20). In the end, Donna Julia is left emotionally hurt and displaced, while Don Juan barely escapes from a physical punishment. Don Alfonso is left betrayed, deceived and not knowing where to turn. The first canto ends with the same disheartened feeling All things that have been born were born to die, / And flesh (which Death mows down to hay) is grass (Byron, I, 220). The allusion of Death mowing the grass of life is comic and serious. Humans age from year to year and their health eventually deteriorates. The same can be said of Don Juans sexual relations. In Don Juan, Byron uses almost every possible variation of epic shadiness, from the fri volous to the almost entirely serious (Clancy, 63). The tone takes a turn for the worse when Juan is refer in a shipwreck. He manages to get aboard a longboat and escape the capsizing ship. Juans luck whole lasts so long for his tutor, who boards the longboat only to be eaten some(prenominal) days later. Just when Juan appears on the brink of death, he floats to safety clutching an oar. The oar can be seen as an obvious phallic symbol, and in turn, it leads Juan to his first accepted love, Haidee. Amidst the barren sand and rocks so rude / She and her wave-worn love had made their bower (Byron, II, 198). The setting of their relationship is perfect, for it is both beautiful and dangerous. As Byron is careful to point out, it is here, on a coast whose perils have been repeatedly emphasized, that the peculiarly harmonious and ideal love of Juan and Haidee is consummated (Ridenour, 44).The love of Juan and Haidee has a quality of magnificence which Don Juan and Donna Julia lacked. The two are portrayed as soul mates that happened upon each other. They were brought together in a stroke of luck and when their union is denied the power of love sours to lust, sex hatred and leering prudishness. What is true love is equally true of the other passionsThe attempt to contain the passions and stop the flow of life always defeats itself in some manner. This is the particular form which the standard satiric plot takes in Don Juan (Kernan, 93). Though Haidee and Juan were meant for each other, Lambro interferes and puts an end to their relationship. He ruins the purity of love, which had ironically been washed up on a beach. Lambro puts Juan into slavery, and furthermore, causes his daughters coma and eventual death. Had he accepted the unification of Juan and Haidee, life in general would have been happier, gayer.Violence and incommode lurk behind tranquility and harmony, and the tranquil and harmonious are fated inevitably to dissolve again in the violent and chaotic. This is an immutable law of Byrons world. Haidee was, Natures bride (Byron, II, 202), and the love she shared with Juan is contrasted in its naturalness with the unnatural situation of woman in society. Their union is almost an act of natural religion. (Ridenour). bloody shame Grant places Don Juan among the different kinds of humor, the mild and pervasive type of Socratic irony, subtle in its half-laughter and half-earnestness, harmonized best with the ease of affability of the sermo, its change of tone from grave to gay, its arts in the absence of art (Ridenour,10).Don Juan is brought to a slave market in Constantinople and bought by a eunuch for the Sultana, Gulbeyaz. The eunuch, Baba, can be seen as a sinister and dangerous character. The technique of associating the subject to be ridiculed with sexual impotence is, of course, a traditional one but the connection surrounded by impotence and lust for power exists on a much deeper level than that of mere invective (Ridenour, 12) . Babas sexual life has been obliterated, and his condition foreshadows a forceful change to Don Juan. This is fulfilled when he is brought to the palace and immediately dressed in womans clothing. Juans gender rearrangement is ironic, and turns bizarre when Gulbeyaz demands him to make love to her. As he is still in mourning for losing Haidee, Juan refuses and bursts into tears. In the accounts of his Juans relations with women, he is not made to appear heroic or even reward and these impress us as having an ingredient of the genuine as well as of the make-believe (Eliot, 97).His actions at first infuriate the Sultana, then she feels compassion, and eventually she cries. Juan is displaced from a man to a weeping woman, while Gulbeyaz turns from a demanding woman to an apathetic female. Communication between the two is short lived as the grand Turk approaches the castle. Upon seeing Juan, the sultan states I see youve bought another girl tis pity / That a mere Christian should be half so pretty (Byron, V, 155). The sultan, who has four wives and undoubtedly several mistresses, comes off as a fool for not noticing that Juan is a male. We can laugh at his blindness, but at the same time, one can only wonder what else he does not see. In Canto I we have the amusing account of the genealogy of Don Juan. Then there is a description of the first of Juans amours, the Julia episode. Canto II continues Juans adventures, including his shipwreck and subsequent love affair with Haidee. In Cantos III and IV the passionate romance of Haidee and Juan comes to its tragic end and Juan is in brief embroiled in the ludicrous seraglio escapade which occupies the whole of Canto V and is concluded in Canto VI (Trueblood, 5).Through these episodes, Byron uses satire to portray sexuality in a comical and serious manner. The poem is a satire on the romantic cult of passion and on the natural man whose passions are his only guide from his proper woes (Clancy, 53). Don Juan is sent on a rollercoaster of sexuality paedophilic love, true love ending in a broken heart and then a confusing, uncertain relation. Through hardships and endeavours, Don Juan comes out a stronger man. From the first six cantos, one can conclude that love, which should be a means of overcoming self, of life story in and for another person, is itself egotistic. The remedy merely aggravates the disorder. It is the same paradox which, in other terms, we have met so often before (Ridenour, 75). The comedic yet serious limning of sexuality makes Don Juan one of the greatest satires even written.

U.S. Equal Employment Essay Example for Free

U.S. Equal Employment Essay1.0 OverviewOver the old period, Human Resources has been affected by both companionable and demographic trends that significantly impact on Equal Employment probability economy and the entire Human Resource Management in general. The research seeks to gauge how effective and successful this impact has been, and what its future in Human Resource Management is.It seeks to describe the major conditions that led to the passing of each piece of EEO legislation that is, championship VII, adenosine deaminase, and ADEA. In each section, we will look at legal, social, political, demographic and economic events. Secondly it will commit the problems these three pieces of legislation intend to let off while comparing with the current status. Finally the research will look at the success of the legislations and consequently their future.2.0 Literature Review2.1 human action VIIThis deals with the refusal of employers to use up an separate as a result o f his race, color, religion, sex and national background. Title VII of the Civil Rights Act prohibits such kind of job variety. It covers all companies with 15 or more employees for more than 19 weeks.2.1.1 Major Conditions that led to the passage of Title VII legislation.Legal conditions accept the Civil Rights Act of 1991 amendment of several sections of Title VII. This amendment made it clear that it would be an un jurisprudenceful occupation practice for an employer to fail to hire or to discharge any individual on the basis of his background. This superlative was a landmark legislation in the United States that outlawed segregation in schools and public places. On political grounds, Title VII requirements were first initiated to garter African Americans but later amended to protect women in courts, and explicitly included white people as well. It withal started the Equal Employment Opportunity Commission. Secondly, if someone has a complaint and another helps the complain ant, the company should not retaliate against either. Thus it gave employees the right to complain. Title VII bill divided and engendered a long change in the demographics of two political parties. However, both sides of the political divide voted for the bill, which won because it increased individual liberty. One of the key provisions by Title VII is the prohibition of unintentional discrimination by use of requirements which move over an adverse effect on protected groups. This is for example the use of educational requirements, tests or other restrictions which atomic number 18 not related to the calling or even required by business necessity.Demographic conditions include the fact that pregnant women also had problems getting jobs and this rose to Title VII act which prohibits discrimination due to pregnancy. It requires that pregnancy be treated the same as any other non-work-related harm.Sexual, racial, religions and pagan bedevilment was another major condition for the rising of Title VII. Thus one major provision of Title VII is the prohibition of sexual, racial, religious, and ethnic harassment by supervisors, coworkers or even by third parties. Discrimination of employees nether such conditions renders companies strictly liable, which results in tangible loss of job benefits.Economically, in ordinate to circumvent limitations on the federal use of the Equal Protection Clause handed down by the Civil Rights Cases, the law was passed under the Commerce Clause.2.1.2 Problems the law intended to remedy. The discrimination of employment was a major problem that this law intended to remedy, thus it prohibits discrimination due to race, color, religion, gender, and national origin in hiring, employment, and termination. These miscellaneous laws intended to enable the fitting treatment of all people from different backgrounds to avoid social menaces such as riots and crime. Title VII aimed to increase individual liberty.2.2 ADAThis means Americans with Disabilities Act. It is a wide-ranging civil rights law that prohibits discrimination based on disability. However, the determination of whether any particular condition is considered a disability is made on a case by case basis. The employing company must modify performance standards to accommodate the disability of an employee. For example, if an employee is unable to meet a target because of disability-related absences, then his job must be reduced. If an employee with up-to-date job requirements suddenly starts having performance problems related to the disability, the company must assess the need for juvenile accommodations such as job transfers. There is also the requirement of provision of extra leave in order to accommodate the disability of an employee. This is for instance by taking measures such as the adoption of an automatic policy of terminations after some leave expires, and even making an individualized determination as to the rigor which would be caused by exten ding the leave. However, the employee does not curb the right to dictate which type of accommodation is chosen by the company, as long as the accommodation allows the employee to do the work. Similarly, the company may not force an employee to take an accommodation whereas by the refusal of that accommodation, if the employee is unable to do the job, the company is entitled to terminate him.2.2.1 Major Conditions that led to the passage of ADA legislation.Employers used to require disclosure of information from applicants including private information. This resulted into discrimination in case the applicant possess information that favored him adversely. The ADA guidelines domiciliate for job applicants not to be asked if they need accommodation to perform the job. They are only supposed to be asked this after the job offer or if they are to be asked, this may happen only in order for them to complete the application process. This prompts the company to ordinarily provide the reques ted accommodation to allow the applicant to complete the application process. Even though it seems completely futile to ask for some positions such as a deaf person applying for a job as a music judge, the applicant must still be allowed to go through the application process. It is abominable to refuse to allow the applicant to make an application and go through the required applicant testing. As a result, companies seeking employees able to perform certain essential physical tasks may indirect request to consider including physical performance testing early in the application process.Legal conditions include circumstances whereby employees used to be discriminated upon and terminated as a result of not being able to do their duties, because of their conditions. In order to be considered covered by the ADA the employee does not need to mention the earthly concern of any disability, or ask for any accommodation. All that is required is for the employee to give sufficient information to let the Company know that he may have a covered disability or may need an accommodation. Secondly, he does not need to propose any specific accommodation, but just identify the existence of an impairment and give a general description of the problems the impairment may be causing.Further, he does not need to provide a checkup release to the company to allow a general review of all medical records, and may limit the release to records which apply to the particular condition at issue. A company has no duty to monitor an employees medications unless failure of taking the medicine by the employee causes the employee not to perform, in which case he should be disciplined.2.2.2 Problems the law intended to remedy.Job applicants with disabilities found it difficult because of being required to give reports or mentioning the existence of inabilities. The results of such requirements led to failure to attain employment and this became a problem that needed to be remedied. Besides the re duction of employment opportunities to the disabled, this law also remedied the problem of the possibility of lost talent which could be possessed by Americans with disabilities.2.3 ADEAThis act is aimed at prohibiting age discrimination in employment. It is the Age Discrimination in Employment Act of 1967, which prohibits employment discrimination against persons 40 years of age or cured in the United States. This law also sets standards for pensions and benefits provided by employers and requires that information about the needs of older workers be provided to the general public. match to the ADEA regulations, it is unlawful for an employer to refuse to hire any individual with respect to his compensation, terms, conditions, or privileges of employment, because of his or her age. Employers should also not limit, segregate, or classify their employees in any mien which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his st atus as an employee, because of age. Reduction of the earnings rate of any employee on the basis of age shall also be unlawful. The ADEA specifically prohibits discrimination in hiring, promotions, wages, or layoffs. This includes statements or specifications in job notices or advertisements of age preference and limitations, and denial of benefits to older employees. An employer may reduce benefits based on age only if the cost of providing the reduced benefits to older workers is the same as the cost of providing full benefits to teenageer workers. Since 1978 ADEA has prohibited mandatory retirement in most sectors, with phased elimination of mandatory retirement for tenured workers, such as college professors, in 1993. In the face of rising productivity and affluence, older workersfind themselves disadvantaged in their efforts to retain employment, and especially to regain employment when displaced from jobs. The setting of arbitrary age limits regardless of potential for job pe rformance has become a common practice, and certain otherwise desirable practices may work to the disadvantage of older persons. commodious term unemployment, may result into deterioration of skill, morale, and the risk of an employer not accepting the job applicant on the basis of age and especially if the applicant is older than average. This is high among older workers and relatively low among the younger ones.2.3.1 Major Conditions that led to the passage of ADEA legislation. There are some circumstances that would lead to the deprivation of employment opportunities to an individual, or limit such employment opportunities. Other circumstances would adversely affect his status as an employee or as an applicant for employment, because of age.2.3.2 Problems the law intended to remedy. What ADEA seeks to remedy includes the reinstatement and back pay for employee or damages if reinstatement is not feasible, or if the employers violation is intentional.3.0 Current StatusThe three curre nt EEO laws have been successful at achieving their intended purposes. As a result of the legislation of Title VII, any employer, grasp organization, joint labor-management committee, or employment agency can bypass the unlawful employment practice for any person involved with any organization required to register as a Communist-action or Communist-front organization by terminal order of the Subversive Activities Control Board. Another positive outcome of the passage of Title VII is that an individual can bring a private causal agency on discrimination. It is unlawful for an employer to discriminate against any of his employees or applicants for employment, because such individual or applicant opposees any practice made unlawful by the ADA legislation, or because such individual or applicant for membership makes a charge, testifies, assists, or participates in any manner in an investigation, proceeding, or litigation under the ADEA legislation. The ADEA law does not forbid favoring the young over the old, but it prohibits having a discriminatory preference for the young over the old. This leads to giving all job applicants equal employment opportunities regardless of their ages. However, it does not apply to state employees because of the Kimel v. Florida Board of Regents. These laws have been successful because then employees become free in working or applying for jobs, It has worked in the US and currently employers are observing the rules. The effects of these legislations have been far reaching and have had tremendous long-term impacts in the US. Some of the effects include the prohibition of discrimination in public facilities, in the government, and in employment, invalidating the Jim Crow laws in the southern US. It became illegal to compel segregation of the races in schools, housing, or hiring. Powers given to enforce the bill were initially weak, but were supplemented during later years.Currently, there are many upcoming events suchas a case study tha t acts as a precedent for futre rulings. Demographic factors arise due immkigrations caused by economic integration and globalisation. All these need to be accomodated and necessay ammendments made to existing laws. The existence of age discrimination in employment because of age affects commerce, and burdens the free flow of goods in commerce. It is therefore the purpose of this chapter to promote employment of older persons based on their ability alternatively than age to prohibit arbitrary age discrimination in employment to help employers and workers find ways of meeting problems arising from the impact of age on employment.4.0 time to come StatusNone of these EEO laws need to be changed. Even though Title I of ADA was found unconstitutional by the United States in the unconditional Court in the case of Board of Trustees of the University of Alabama v. Garrett, and found to be violating the States Eleventh Amendment to the United States Constitution sovereign immunity rights, it allowed the states to be sued for money damages. This is an meter reading that the legislation is in force.Title VII and the ADA may be generally applicable when a charge challenges discrimination by a remote or foreign owned employer within the United States. However, such a respondent may allege that it is protected by the terms of a agreement or international agreement that limits the full applicability of U.S. anti-discrimination laws. The 1978 Amendments to the Age Discrimination in Employment Act will ultimately affect the future labor force. The retirement age policies have been hurting older workers, but changes that are expected to occur will ensure better terms for them. Pension benefits have also been affecting the older work force but the future holds better terms for them. It also leads to the urge of a linked employment or retirement policy.Companies and other employers are likely to respond quickly in the future to avoid legal charges, so that they may not be see n as having refused to adhere to a law. Finally, there would be more business as a result of a variety of intellectuals in the work force, both young and old, people of different backgrounds and even those with disabilities.5.0 ReferencesBrauer, Carl M., (1983) Women Activists, Southern Conservatives, and the Prohibition of Sexual Discrimination in Title VII of the 1964 Civil Rights Act, 49 Journal of Southern History.DeLeire, Thomas. Fetal Alcohol Syndrome

fetal Alcohol Syndrome foetal Alcohol Syndrome is a series of receive defects such as physical, mental, behavioral and learning problems caused by the mother drinking alcohol during pregnancy. Kenneth Jones and David Smith at the University of Washington in Seattle officially identified foetal Alcohol Syndrome in 1973 (Golden 1). The exact reasons certain fetuses are affected and others are not, is not fully understood. CDC reports state that 0.2 to 1.5 per 1000 babies are born each year in the coupled States with alcohol related induce defects (CDC 1).Fetal Alcohol Syndrome can be prevented with education. Even small win overs in education and behavior can reduce the assay of women giving birth to babies with fetal alcohol syndrome. Women have been drinking for years not knowing or understanding the entraps that alcohol had on their babies. round women that drink do not even know they are pregnant and may unknowingly and unintentionally cause damage to the unborn and develop ing baby. wherefore there are the women that are addicted to alcohol. The drive can be stronger for the alcohol than for the health of herself or her unborn baby. Education, behavior modification and detoxification are areas of change needed to help with prevention of Fetal Alcohol Syndrome. When alcohol is consumed it is absorbed into the mothers bloodstream and passed through the placenta and into the central nauseated system of the fetus. Alcohol depresses the central nervous system of the fetus. Alcohol is a potent teratogen. A teratogen is any substance which has been proven to cause birth defects. It is not fully known if it is the alcohol or acetaldehyde, which is a breakdown product from alcohol, which causes birth defects. How the damage occurs is not completely understood, but alcohol does create a glucose and oxygen deficit for the fetus (Spong 1). in that respect is increased risk for miscarriage, stillbirth, and birth defects in women that drink, peculiarly in the fir st trimester. Also, the amount of alcohol economic consumption can multiply the chances of these effects. The organs of the fetus undertake developing between three to ten weeks. Alcohol may affect the developing organs such as the heart, brain and central nervous system. Because of the effect on the brain, alcohol can cause mental slowness. Damage to the brain can happen anytime during the pregnancy since the brain develops for all nine months and beyond birth (Belfort 2006).The effects of the alcohol can vary in range of severity and parts of the anantomy. Some babies are born with growth deficiencies due to the alcohol manipulation during pregnancy. They are short in length, under weight, and have small heads (Wong). Facial abnormalities hold small eye openings, drooping eyelids, skin folds across the inner corners of the eyes, a flattened or missing bridge of the nose, underdeveloped philtrum, thin upper lip, cleft lip, and cleft palate (Wong). There are major organ defects, especially of the heart such as septal defects, tetralogy of Fallot, and patent ductus arteriosus (Wong). They may have problems with their respiratory system such as apnea, pulmonary hypertension and SIDS. Renal abnormalities include aplastic, dysplastic, hypoplastic kidneys, horseshoe kidneys, ureteral duplications, and hydronephrosis (Wong 844). They may have joint and limb abnormalities. Some of the skeletal abnormalities are restriction of movement, altered palmar crease patterns, hypoplastic nails, slashed digits, radionulnar synostosis, flexion contractures, pectus excavaum and carinatum, Klippei-Feil syndrome, hemivertebrae, and scoliosis (Fry-Johnson 42) . Malformation of the Eustachian tube, conductive hearing loss and nuerosensory hearing loss are some auditory defects. They tend to have chronic ear infections. They have a tendency to be more susceptible to infections (Wong 844).Malnutrition is a risk factor for women that drink and can lead to birth defects. Malnutrit ion can cause low birth weight, growth retardation, fetal damage, and is an increased risk for spontaneous abortion and stillbirth. There are several reasons for the malnutrition. First, alcoholics prefer alcohol over food therefore the intake of needed nutrients is poor. Then there is reduce absorption and metabolism of nutrients.Women that drink can be deficient in many vitamins and minerals such as vitamin B6, folic acid, riboflavin, thiamine, vitamin K, iron, atomic number 12 and atomic number 30. Deficiency in vitamin B6 can result in a clubfoot, cleft lip and palate. Folate acid deficiencies are related to neural tube defects and orofacial defects. hepatoflavin deficiency may affect failure to grow, thrive and develop. Lack of thiamine has been found to cause heart defects. Deformities related to vitamin K deficiency are shortened fingers, cupped ears, flat nasal bridges, and underdeveloped nose, mouth and mid face. Babies that are born iron deficient are often smaller and sh orter. Deficiency in zinc has been linked to impaired growth and development. Zinc deficiency has been related to lower immunity in infants and abnormalities of the nervous system that lead to learning difficulties and mental retardation (Anderson 3).According to an article by Mary J. OConnor in the American Journal of Drug and Alcohol abuse, kidren with fetal alcohol syndrome may show cognitive and assist deficits, increased activity levels, problems in inhibition and state regulation, perseverative behavior, and expressive language and motor problems. These problems may last into and throughout adulthood. They may have difficulties such as bonding in infants and depression in 4-6 year olds. There have been reports of depression, anxiety, psychosis, somatic complaints, delinquency, hyperactivity and sleep disorders. OConnor also reports in a study done on 473 people that were prenatally exposed to alcohol 44% were diagnosed with major depressive disorder, 40% had psychotic disord ers, and 20% had bipolar disorders(Womens Health1). Studies on prenatal alcohol exposure and relation to IQ show varying severities. It was noted that some children for unknown reasons are more susceptible than others to the effects of alcohol. An article in Journal of School Health by Jennifer H. Green reports on a review of studies done showing an average IQ for people with fetal alcohol syndrome at 65.73 with a range of 20-120 (Green 1).Fetal alcohol syndrome is a preventable problem. The public needs to be educated on the effects alcohol can have on an unborn child and that no amount of alcohol is safe during pregnancy. The effects from alcohol ingestion during pregnancy can range in severity and last a lifetime. healthcare worker must educate and advise all females within childbearing years of the potential harm to the fetus. During pregnancy it is never too late to term of enlistment and reduce the risk to the fetus. Ultimately it is up to the mother to follow through with t hese warnings and advice.Work CitiedAnderson, Mark. Historical Perspective Prenatal Nutrition and Birth Defects. Selen River Press, 2008.
